Terms of service
The short version
Think of this as the fine print behind the fibre — necessary, if not thrilling. Using our site means you're agreeing to it, so here's the headline version before the full detail below:
- Prices, offers and product details can change — you'll always see the final price before you pay.
- We might occasionally have to decline or adjust an order (out-of-stock happens, even to a 15-plant granola).
- Subscriptions are entirely in your hands — pause, skip, swap or cancel whenever suits you.
- We take reviews seriously: real feedback from real customers, published as written.
- There are a few things we ask you not to do — nothing dramatic, just the basics of playing nicely.
- We're responsible for what we can reasonably foresee going wrong, and we explain exactly what that means in Section 18.
- If these Terms are breached, we may need to end someone's access — we'd rather that never happens.
Please do read the whole document, especially our responsibility to you (Section 18), reviews (Section 12), and what happens if these Terms are breached (Sections 15, 17 and 19).
Overview
Welcome to Bio&Me! "We", "us" and "our" refer to Bio&Me. Bio&Me operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Bio&Me is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced here (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
Section 1 — Access and Account
By agreeing to these Terms of Service, you represent that you are at least 18 years old, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including browsing our online store or purchasing any products we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete, and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
Section 2 — Our Products
We make every effort to represent our products accurately, including ingredients, nutritional information and allergen information. However, recipes can change, and product images are for illustration — packaging, pack sizes and appearance may vary from what's shown online.
Always check the physical packaging for the most current ingredient, allergen and nutritional information before consuming, particularly if you have a food allergy or intolerance. If anything on our website conflicts with what's printed on the pack, the pack takes precedence.
All product descriptions, pricing and availability are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit quantities of any product to any person, geographic region or order, on a case-by-case basis.
Section 3 — Orders
When you place an order, you're making an offer to purchase. Bio&Me reserves the right to accept or decline your order for any reason at its discretion. Your order isn't accepted until we confirm acceptance, and we must receive and process your payment before that happens. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order is accepted. If we don't accept, change, or cancel an order, we'll attempt to notify you using the email, billing address, and/or phone number provided at checkout.
Your purchases are subject to return, replacement or refund solely in accordance with our Returns & Refunds policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4 — Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Unless otherwise stated, prices shown include UK VAT where applicable; delivery, customs or import charges (for any international orders) are shown separately at checkout.
Prices in our online store may differ from prices in physical retail stores or other online stores. We may run promotions that are governed by their own terms; where those conflict with these Terms, the promotion terms apply for that promotion.
You agree to provide current, complete and accurate purchase, payment and account information, and to promptly update it (including your email address and payment details) so we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are authorised to use the payment method provided, (iii) charges will be honoured by your card issuer or payment provider, and (iv) you will pay all charges incurred at the posted prices, including delivery and any applicable taxes.
Section 5 — Subscriptions
Some products are available on a recurring, subscription basis. If you choose a subscription option:
- You authorise us to automatically charge your chosen payment method at the frequency you select, until you cancel or the subscription otherwise ends.
- You can view, pause, skip, amend or cancel your subscription at any time through your account, subject to any minimum term stated clearly at the point you subscribed.
- We'll give you reasonable notice of any change to your subscription price before it takes effect. If you don't cancel before the new price applies, we'll treat that as your acceptance of the change.
- We may change the third-party platform or provider we use to manage subscriptions from time to time. This won't affect your rights under these Terms.
We aim to make subscribing and cancelling straightforward at every step, in line with UK consumer protection principles for subscription contracts.
Section 6 — Shipping and Delivery
We'll always try to get your order to you within the estimated timeframe shown at checkout, though we can't guarantee our courier partners won't experience delays.
If nobody's home, our courier will generally leave your parcel in a safe place. The instructions for this are at your discretion directly with the courier.
If your order hasn't arrived within 7 days of your shipping confirmation email, please get in touch within 30 days of placing your order so we can look into it while there's still time to put things right.
Risk in the products remains with us until you (or someone you've nominated) receives them. If your order arrives damaged, or doesn't arrive at all, this is covered under our Returns & Refunds policy — you won't be left out of pocket for something that happened in transit.
Section 7 — Intellectual Property
Our Services — including trademarks, brands, text, displays, images, graphics, product reviews, video and audio, and their design, selection and arrangement — are owned by Bio&Me, its affiliates or licensors, and are protected by UK and international copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works from, publicly display or perform, republish, download, store, or transmit any material on the Services without our prior written consent. Nothing in these Terms grants you any licence or right under any patent, trademark, copyright or other intellectual property of Bio&Me, Shopify, or any third party, except as expressly stated. Unauthorised use of the Services may infringe intellectual property law.
Bio&Me's names, logos, product and service names, designs and slogans are trademarks of Bio&Me or its affiliates or licensors, and must not be used without our prior written permission. Shopify's name, logo, and related marks are trademarks of Shopify. All other names, logos and marks on the Services belong to their respective owners.
Section 8 — Optional Tools
You may be given access to tools offered by third parties as part of the Services — for example, product recommendation quizzes, review platforms, or other embedded third-party functionality — which we don't monitor or control.
We provide access to such tools "as is" and "as available," without any warranties or endorsement, and we have no liability arising from your use of them. Any use of optional third-party tools is entirely at your own risk, and you should familiarise yourself with that third party's own terms.
We may in future offer new features through the Services, including new tools and resources. These will also be part of the Services and subject to these Terms.
Section 9 — Third-Party Links
The Services may contain links to websites operated by third parties, including embedded third-party functionality. We're not responsible for the content or accuracy of any third-party materials or sites, and if you leave the Services to access them, you do so at your own risk.
We're not liable for harm or damages related to your access to, or purchases or use of, any third-party website, product, service or content. Please review any third party's own policies before transacting with them. Complaints about third-party products or services should go to that third party directly.
Section 10 — Relationship with Shopify
Bio&Me is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Bio&Me. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Bio&Me, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Bio&Me.
Section 11 — Privacy Policy
All personal information we collect through the Services is subject to our Privacy Policy. We process personal data in accordance with UK data protection law, including the UK GDPR and the Data Protection Act 2018 — see the Privacy Policy for full detail on what we collect, why, and your rights.
Because the Services are hosted by Shopify, Shopify also collects and processes personal information about your use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and other third parties, including ones located outside the UK, in order to provide the Services to you. Shopify's own privacy policy is available on their website.
Section 12 — Feedback & Reviews
If you submit any ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium, for any purpose, including commercially — for example, to improve or promote the Services.
Where you leave a product review, we publish genuine reviews from real customers, and we take reasonable steps to check reviews are genuine before they go live, in line with UK consumer protection law. We don't edit reviews to change their meaning, and we don't remove reviews just because they're negative — though we may remove reviews that are fake, abusive, or otherwise breach these Terms.
You represent and warrant that: (i) you own or have all necessary rights to your Feedback; (ii) you've disclosed any compensation or incentive you received in connection with it; and (iii) it complies with these Terms. We're under no obligation to keep Feedback confidential, pay for it, or respond to it, and we may (but don't have to) monitor, edit or remove Feedback we consider unlawful, offensive or otherwise objectionable.
You agree your Feedback won't infringe any third party's rights (including copyright, trademark or privacy), won't be unlawful, abusive or obscene, and won't contain malware. You won't use a false identity or otherwise mislead us as to the origin of your Feedback. You're solely responsible for your Feedback and its accuracy; we take no responsibility for Feedback posted by you or any third party.
Section 13 — Social Media & Community Guidelines
We love chatting with you on social media — that's where a lot of our best conversations about gut health (and the occasional questionable joke about fibre) happen. To keep it a good space for everyone, please keep comments respectful, on-topic, and free of harassment, hate speech or spam.
We do our best to reply to and moderate comments quickly, but we can't be responsible for the accuracy of anything posted by other users. We may remove comments, or block accounts, that don't meet this bar.
Section 14 — Errors, Inaccuracies and Omissions
Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We reserve the right to correct these, and to change, update or cancel orders based on inaccurate information, at any time without prior notice — including after you've placed an order.
Section 15 — Prohibited Uses
You may access and use the Services for lawful purposes only. You may not use the Services to: act unlawfully or maliciously; breach any applicable law or regulation; infringe our intellectual property or that of others; harass, abuse, threaten or discriminate against any person on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; transmit false or misleading information; send spam or unsolicited promotional material; impersonate any person or entity; or engage in conduct that restricts others' use of the Services or that we determine may harm Bio&Me, Shopify, or other users.
You also agree not to: upload viruses or malicious code; reproduce, duplicate, extract or exploit any part of the Services for resale; collect or track others' personal information; phish, pharm or pretext; use bots, scrapers, automated tools or AI agents to access the Services except as permitted under Section 16; or bypass, interfere with or circumvent our security or access-control measures. We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine you've breached these Terms.
Section 16 — Agents
16.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity, and that can be executed on their behalf or using their device, without direct supervision.
16.2 No Agent may access, use, or interact with the Services unless it identifies itself and operates strictly in accordance with Section 16.4 below at all times. No Agent may access, use, or interact with the Services if we've asked that Agent to refrain from doing so.
16.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, or interacts with the Services.
16.4 Agents must: (i) identify themselves as an Agent in all HTTP/HTTPS requests, by including "Agent/[agent name]" in the request's user agent string; (ii) not conceal or obfuscate that an interaction comes from an Agent, including by mimicking human behaviour or completing/circumventing CAPTCHAs; (iii) respond truthfully to any question or prompt seeking to determine whether an interaction is human or automated; and (iv) not circumvent any measure intended to block, limit, modify or control how Agents access, use or interact with the Services.
Section 17 — Termination
We may terminate this agreement or your access to the Services (or any part of them) at our discretion, at any time, without notice, and you'll remain liable for all amounts due up to and including the date of termination. If we close your account, we may also prevent you from opening a new one.
The following sections continue to apply after termination: Intellectual Property, Feedback & Reviews, Termination, Our Responsibility To You, Your Obligation to Compensate Us, Miscellaneous, Governing Law, and Privacy Policy, and any other provision that by its nature should survive termination.
Section 18 — Our Responsibility To You
We don't exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your statutory rights as a consumer under the Consumer Rights Act 2015 — for example, that goods will be of satisfactory quality, fit for purpose, and as described. Nothing in these Terms takes those rights away.
We're responsible to you for foreseeable loss and damage we cause. If we don't meet our obligations under these Terms, we're responsible for loss or damage that's a foreseeable result of us breaking the contract, or failing to use reasonable care and skill — but not for anything that isn't foreseeable. Loss is foreseeable if it's obvious it will happen, or if both of us knew it might happen at the time you placed your order.
Beyond that, we won't be liable for other losses, claims or expenses arising from your use of, or inability to use, our site or products, including if we end your rights under these Terms (Section 17).
We don't guarantee that the site will be uninterrupted, timely, secure or error-free, and we may remove or suspend all or part of it at any time without notice or liability.
Section 19 — Your Obligation to Compensate Us
If you breach these Terms — including through any of the prohibited activities in Section 15 — you agree to compensate us for any reasonably incurred costs, losses or damages we suffer as a direct result.
Section 20 — Force Majeure
Sometimes things happen that are genuinely outside anyone's control — extreme weather, natural disasters, war, civil unrest, pandemics, strikes, or courier network failures, for example. If an event like this stops or delays us fulfilling your order, we won't be liable for that delay or failure, though we'll always try to keep you updated.
If we can't ship your order within a reasonable time because of an event like this, we'll offer you the choice of waiting for it or a refund.
Section 21 — Miscellaneous
If we don't enforce a right or provision under these Terms, that doesn't mean we've given it up — we can still enforce it later.
If any part of these Terms is found unlawful, void or unenforceable, that part will be removed and the rest will continue to apply.
We may transfer our rights and obligations under these Terms to another organisation; this won't affect your rights or our obligations to you. You may not transfer your rights or obligations under these Terms without our prior written consent.
Section 22 — Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. You and Bio&Me agree that the courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms or your use of the Services — except that if you're a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the UK where you live, and you'll continue to benefit from any mandatory consumer protections of the law where you're resident.
Section 23 — Headings
Headings in these Terms are for convenience only and don't affect their meaning or interpretation.
Section 24 — Changes to These Terms
We may update these Terms from time to time — to reflect changes to our site or products, changes in the law, or how we operate. Minor changes (ones that don't substantially affect your rights) take effect as soon as we post the updated version. For material changes (ones that do), we'll give you reasonable notice before they take effect, for example by email or a notice on the site.
Continuing to use the site or place orders after a change takes effect means you accept the update. If you don't agree with a change, please stop using the site.
Section 25 — Contact Information
Questions about these Terms should be sent to us at hello@bioandme.co.uk. We do our best to get back to you as quickly as we can.
